about to show you, you'll see why we're concerned about this storm anyway. let's show you the deepening center of this storm, as it exploded in strength overnight. look at the dark center there, as it hopped off jamaica to the eastern end of cuba. that's the center of this storm. the water is 80s. it's going to stay the same strength, or weaken over the next few hours as it heads to the bahamas. as we look at what's ahead for the storm and the combination of storms heading towards it, it reminds us a lot of another storm in recent history. category 2 hurricane sandy will roar through the caribbean, after pounding jamaica and cuba. with winds up to 114 miles per hour. this storm has already taken two lives. and forecasters fear it will soon be similar to another powerful storm that occurred in 1991. >> we're looking at 40-foot to 50-foot waves, gale force winds. >> it would be a disaster of

epic proportions. it would be, the perfect storm. >> reporter: but the perfect storm stayed off the coast of new england, when hurricane grace joined with a powerful nor'easter, bringing 50-foot waves and gale-force winds. >> rogue wave! >> look out! >> reporter: this storm could be worse. and forecasters say it could blast much of the east coast, even coming onshore, starting this weekend. as hurricane sandy moves up the coast, it will meet up with an arctic front moving across the u.s. and get extra support from the jet stream, with a blast of arctic air from the north. three elements colliding over the country's most populated corridor. this is exactly what steers that storm system. right now, the idea is that sandy will continue to weaken as it moves up the atlantic seaboard. but this front has a tendency to draw systems toward it. any cold front kind of does. it looks like this system will get so far and then try to make a little hook in. that hook will be anywhere from the delmarva peninsula to the new york long island area right there. we believe this storm system will be a hybrid storm by the time it moves there.

and the forecast models are kind of agreeing with that. you remember, a couple of days ago, they were laying it all out toward the atlantic. one or two still do. but most of them in the trusted models will curve this thing in as we get to monday and tuesday of next week. making a big rainmaker, some flooding. some gusting winds. a lot of trees down, a lot of power outages. we'll follow it, moment by moment. george? the race for the white house now. it's "your voice, your vote," with just 12 days to go. president obama and governor romney in a final sprint across the key battleground states. the president flying overnight to florida. and abc's jake tapper is in tampa right now. good morning, jake. >> reporter: good morning, george. it is a dogfight. and the latest abc news/"washington post" poll, mitt romney is up one point in the national, popular vote. but a new poll out of critical battleground state ohio has president obama up five points. overnight, president obama launched a new attack against romney. while you were sleeping, president obama was campaigning. a nighttime rally in las vegas with katy perry.

♪ baby, you're a firework >> reporter: the third of the day, in as many states. where he continued to suggest mitt romney is not trustworthy. >> in the final weeks of this election, he's been counting on you to forget. he's hoping you come down with what? [ crowd answers ] >> all: romnesia. >> he's hoping you come down with what we call romnesia. >> reporter: he visited "the tonight show with jay leno" where he addressed the comments made by republican senate candidate richard mourdock, who said this in a debate on tuesday, of why he opposes abortion even in the case of rape. >> when life begins in the horrible situation of rape, that is something that god intended to happen. >> i don't know how these guys come up with these ideas. let me make a very simple proposition. >> mm-hmm. >> rape is rape. >> reporter: it's an issue the president is trying to tie to mitt romney, with tweets, e-mails, and this new web ad, highlighting how running mate paul ryan also opposes abortion

in cases of rape. campaigning in just two state, both of them battlegrounds, mitt romney tried to sound a note of inevitability. >> the obama campaign is slipping and shrinking. our campaign is a growing movement across this country. >> reporter: this week also brought some odd sideshows. romney surrogate donald trump offered to give $5 million to a charity of the president's choice, if the president released his college records and passport application. >> i have a deal for the president. >> what's this thing with trump and you? >> this all dates back to when we were growing up together in kenya. [ laughter ] >> yeah. >> and, uh -- >> reporter: over the next week, both campaigns and their official surrogates and allies will spend about $80 million in battleground states, just on tv ads. including this one, featuring clint eastwood. and this one, featuring the first lady. and of course, early voting so important in these battleground states. here in florida and in nevada

overnight, president obama met with some union workers at the bellagio hotel and casino. he urged them to vote early just in case on election day, they have to pull a double shift. >> one-third of voters voting by election day. jake, thanks very much. let's get to josh with the headlines. >> good morning. we're going to start with the federal government hitting bank of america with a billion-dollar lawsuit for its role in the housing market collapse. the suit says there was a massive mortgage fraud, including program called the hustle, to crank out loans as quickly as possible. the feds say, the hustle, which began at countrywide, before bank of america bought it, resulted in thousands of risky, rubber-stamp loans that then went bad. another story hitting americans in the wallet this morning, the price of meat -- everything from beef to chicken and turkey, is about to skyrocket. the government warning consumers that many farmers recently sold off their animals because of the extreme drought in the country. that means there's a temporary glut of meat on the market right now. but when that supply dwindles, one expert warns prices will be

shooting up, and i quote, in a big way, end quote. and the death toll from the national meningitis outbreak has now climbed to 24. the latest victim got a steroid shot for back pain in indiana. 317 people in the states you see highlighted here have gotten sick. now, the cdc says that patients are at high risk for as long as six weeks after being injected. the fbi is hoping to question a man arrested in connection with the deadly attack on the u.s. consulate in libya. 28-year-old ali harzi is facing terrorism charges in tunisia. his attorney claims harzi is only a scapegoat to satisfy america. a second suspect has reportedly been killed in egypt. a historic game one of the world series. giants slugger pablo sandoval, third baseman nicknamed the panda, hit not one, not two, but three home runs. joining babe ruth, reggie jackson and albert pujols as the only four players to pull off that feat in the fall classic.

the giants routed the detroit tigers in game one, 8-3. and thankfully, those of us on the east coast got to go to bed a little early. finally, you don't have to be a grown-up to make a difference in this world. look what 11-year-old dante cano from new jersey did. he had an idea the other day. he was watching football. and he thought, why do the refs' penalty flags have to be yellow? why can't they be pink for breast cancer awareness month? so, he wrote a letter to roger goodell, the commissioner of the nfl, which has partnered with the folks at susan g. komen and have made pink gear a part of the month-long in the nfl. but guess what? this sunday, at the jets game, first time in 50 years, the refs' flags will be pink. >> i love it. yay. >> there you go. >> thanks to dante. it was a 40-word letter from a fifth grader. >> do we know why a little boy would want to do that? >> we don't know why.

but he did send it, perhaps, for you know, feeling better for his fellow man and fellow woman. >> love it. >> he sent it off. 40 words later, he got it done. >> all right, josh. thanks so much. >> thank you, dante. we turn, now, to very serious news and a shocking update in the death of 10-year-old jessica ridgeway. colorado police arresting a teenage community college student in the little girl's murder. austin reed sigg is set to make his first court appearance today. abc's clayton sandell has the story. >> reporter: investigators overnight scoured the westminster, colorado, home where austin sigg lives with his mother. fbi agents combed the backyard for clues. police towed away this car. >> i believe we have taken a significant step towards justice for jessica. >> reporter: sources tell abc news that sigg confessed the crime to his mother, who called police so her son could turn himself in. austin caisse has known the suspect since elementary school. >> he was always egotistical.

but never thought he would go this far. he was never that violent of a person. he was always more bark than bite. >> reporter: sigg is a community college student where classmates say he was studying mortuary science. in heel, he took second place in a competition involving crime scene investigations, or csi. >> it's not uncommon for people who abduct women to be fascinated by crime and crime detection. >> want to be on camera? >> reporter: jessica vanished october 5th on her walk to school. her body was found a few days later. sigg lives less than a mile from her home, about a half-mile from her school, and close to this reservoir. that's where he allegedly attacked a 22-year-old female jogger in may, covering the woman's face with a rag that smelled like chemicals. authorities are also looking at this 2009 youtube video that briefly shows a boy that looks like sigg wearing a small cross. it appears to be similar to one that police say they found at a crime scene.

>> i remember him wearing a necklace with a small cross on it. i never put two and two together. >> reporter: with the suspect now under arrest, people in jessica ridgeway's community hope their nightmare is over. >> it's terrifying. i don't know why somebody could do this to somebody else. >> reporter: later this morning, sigg will be in court for his initial appearance, facing charges of kidnapping and murder. the d.a. says he will charge the 17-year-old as an adult. as a juvenile, he will not be eligible for the death penalty. amy? >> all right, clayton, thanks so much. for more, now, let's bring in "gma" legal analyst dan abrams. we heard clayton say, police are charging sigg as an adult. what does that mean? >> it means that he will be tried like any other adult would. in fact, 17 is not the lowest age. you can go younger in the state of colorado and be charged as an adult. as you heard him say, the supreme court has ruled that no one under the age of 18 can be charged with the death penalty. can face the possibility of the death penalty. so, that's the only protection he has as a juvenile. but for now, he is still effectively considered a

juvenile. that's very quickly going to change. >> interesting if his age becomes an issue with his confession. he's waived his rights. he's confessed. could age be a factor as we go forward? >> it's something his team will undoubtedly bring up when trying to get his confession excluded, if they do. but it is not likely going to be a winning argument. they're going to have to come up with more than just his age. they could probably argue his age in conjunction with other things. very unlikely. his mother was involved in turning him in, et cetera. so, i would think they're going to have a tough time getting that confession excluded. >> dan abrams, thanks so much. we appreciate your time. george? >> thanks, guys. now, to the growing debate over the future of football. millions of kids across the country are going to take the field this weekend. but a doctor in one town has sparked a fierce response with his call on parents to put a stop to the sport in high school. abc's dan harris has the story. >> reporter: high school football, an american institution. and reflected time and again by hollywood. so, when this mild-mannered school board member at a

sparsely attended meeting in dover, new hampshire, advanced a radical idea -- >> we have a moral imperative to at least begin the process of ending this game. >> reporter: -- it sparked an instant uproar. >> a surprising proposal at a school board meeting. >> reporter: the media got wind. >> now, the future of the program, in jeopardy. >> reporter: and the coverage went national. the board member in question here is paul butler. a retired doctor and former high school football player himself, who says the beloved dover high school team, the green wave, has to go. >> the literature is clear. this is a dangerous game for children to be playing. >> reporter: espn's "sportscinece" says big blows like this one can be the equivalent of taking a sledgehammer to the head. it's not just pro football. new studies show that kids that play high school football and peewee league football, are

stronger winds and the roughest surf as the system continues to cruise east. we'll watch it wherever it goes. here comes the shot of colder temperatures. now, look at this. 26 degrees in billings. that's the start temperature but also the end temperature, it's that cold. kansas city, starts at 71, but drops all day long, as the powerful cold front moves through. that time of year.

that's right. lindsay boyd was a teenager when she let a videographer shoot her flashing him at spring break. but that video was sold to a "girls gone wild" film. now, after fighting the company that bought her video, early next month, she'll finally have her day in court. this is the image that lindsay boyd says ruined her reputation and her life. a single frame of video that turned a teenage girl into a topless cover model. >> a stupid, split-second decision that you make can follow you around the rest of your life. >> reporter: lindsey boyd, now a 26-year-old mother, was just 14 when she was approached by two men with a video camera during a spring break trip to florida. >> i don't really remember what they said. but i flashed them. >> reporter: those few seconds of video were later sold to the makers of this "girls gone wild" video, with her face plastered

right on the cover. >> they didn't have big equipment with them or "girls gone wild" t-shirts. >> reporter: boyd says she didn't even find out until high school. >> teachers knew about it. coaches knew about it. it was devastating. it was so embarrassing. >> reporter: in 2004, she sued the makers of the video, arguing her image was used for commercial purposes without her consent. >> she bared her breasts for some man, some men. and unbeknownst to her, she never dreamed that -- or didn't dream it would be used for -- in "girls gone wild." >> reporter: the suit has been tied up in knots ever since. moving between state and federal court. in part, lawyers say, because georgia law isn't clear on whether she even has a case. >> what the defendants are arguing is that she can't later claim, oh, her right of privacy was somehow violated, because she, in fact, consented to do this in a public arena. >> reporter: but now, after years of legal wrangling, boyd's suit will finally be heard november 5th in georgia's supreme court.

asked to decide whether a now adult boyd has the right to sue over a teenage mistake. >> what people say and think, it's forever. >> reporter: just 14. the defendant's mra holding said they purchased the footage from an independent third party and believe that boyd doesn't have a legal leg to stand on. but we'll see in court. >> a long time coming. thanks so much. now, another bitter courtroom battle, this time between britney spears and her former manager. sam lufti accuses britney's father of attacking him and threatening his life just days before britney's public meltdown. abbie boudreau has the story. ♪ >> reporter: these days, britney spears' life is pretty drama-free. a devoted mom, who earned $58 million last year. she had a hit album, "femme fatale." and is now a judge on popular talent show, "x factor."

>> you can't destroy that song, swe sweetie. >> reporter: five years ago, britney's life was spiraling out of control. and now, new details of that public meltdown are being revealed this week in a los angeles courtroom. >> i can't answer that question. >> reporter: sam lufti claims he's the pop star's former manager and is suing britney's parents for defamation, libel and breach of contract. >> during the course of this, all sorts of nastiness is coming out. allegations of drug use. allegations of psychological issues. >> reporter: in court wednesday, lufti claimed britney's parents were out of control, too. testifying that the superstar's father once chased him around the kitchen, punched him and threatened his life after an argument about britney's condition. the spears deny this. and lufti broke down on the witness stand, saying he contemplated suicide, after britney's mom wrote a book

accusing him of hiding britney's cell phone. lufti claimed that's untrue. and tearfully said, after the book came out, there was a huge spike in death threats. there were people wishing i was dead. lufti also testified that that famous head-shaving incident was to prevent britney's hair follicles from being tested for drugs during her custody battle for her sons. >> this is a respect for how high she's risen and how low she was. >> reporter: britney was not in court. but her parents were. her mom, crying in the courtroom, as the jury watched a video of spears fighting with the paparazzi. >> the thing britney would like most is to forget the bad part. look to the future, which is very bright. >> reporter: we reached out to britney's lawyer overnight about the shaved head allegations and got no response. court will be back in session later today. amy? >> abbie, thanks so much. i'm sure there will be more updates on that. you know who we need an update from? sam champion. there's a lot going on in the weather world.

national polls. and he's closed the gap among women. but challenges remain in the battleground states. one adviser admits, the math could be more daunting, than the politics here. and the teenager arrested in the abduction and murder of 10-year-old jessica ridgeway near denver is due in court today. investigators are still collecting evidence from 17-year-old austin sigg's home, not far from the community college where he is studying forensics and mortuary science. sources say sigg confessed to his mother, who called police. and with halloween less than a week away, health officials are sounding the alarm on decorative contact lenses. they say ill-fitting lenses could scratch one's cornea, causing infection or leading to blindness. officials in florida are fining stores, ordering them to stop selling the lenses. finally, a lighter moment from the campaign trail. you would think it would be tough to upstage the president.

a very important question. can you really get your lashes to look like natalie portman's in her christian dior ad? the ad is now banned in some places, under fire for allegedly misleading consumers. abc's paula faris has the story. >> reporter: it supposed to lengthen, thicken and valiumize. morphing eyes from this, to this. but can mascara really do this? this ad featuring natalie portman and her lush lashes is at the center of a battle between two of the largest beauty companies. this christian dee yarr mascara ad featuring portman was banned in the u.k. tuesday, the company accused of misleading customers. making them think the mascara would achieve the look in the picture. >> when they do cross it, that's when the problems happen. >> reporter: wednesday's ban came after beauty giant l'oreal campaigned to british

authoriti authorities, saying the competition was exaggerating the effects of the mascara. dior denies it. although, the ad lashes were increased the length, more a more stylized effect. >> advertisers are trying to be aspirational. >> reporter: last july, it was l'oreal that came under fire from the same u.k. council for this julia roberts ad. and in the u.s., ads like this are everywhere. and companies can't or won't call each other out for making false claims. so, just how do the stars and models in ads achieve those luscious lashes in beauty magazines. we checked in with beauty expert greta monahan, who says fake lashes are the way to go. >> typically, what i need to do if i want a magnified effect, a movie star effect, is to use false lashes and mascara.
